Hi Val, I believe you are in Florida, as am, I and I am curious to how our registery works here. I know we have "offender" vs. "predator", but do we also have a "tiered" system here? You seem to understand a lot about this, so I thought I would ask. Also, do all registered sex offenders have to register for life or is that determined by the judge? Thanks!

You opened up a can of worms with that question. One would think it would be a simple yes or no but it isnt. To me as of today "NO" Florida has not. But I think last year the "voodoo doctors" took about 1700 or so registrants and attempted to implement this part of SMART and or the AWA. If one looks at their immediate registry as I often do, Tier Levels are not listed. In as much as I hate to refer anyone to Oncefallen's website he does have a page with a timeline (even though its not updated on the implementation of this act. The latest update on States is
http://www.gao.gov/assets/660/652032.pdf
Pay special attention to pages 17,page 19 and page 29 (Florida)

Another can of worms question on "having to register for life"
There are certain crimes that mandate lifetime registry in Florida these are:
Current law requires life-time registration for those who have been convicted of certain crimes. These crimes include:
•Kidnapping
•False imprisonment
•Luring or enticing a child
•Sexual battery
•Unlawful sexual activity with certain minors
•Procuring person under age of 18 for prostitution
•Selling or buying of minors into sex trafficking or prostitution
•Lewd or lascivious offenses committed upon or in the presence of persons less than 16 years of age
•Lewd or lascivious offenses committed upon or in the presence of an elderly person or disabled person
•Sexual performance by a child
•Computer pornography
•Transmission of pornography by electronic device or equipment
•Transmission of material harmful to minors to a minor by electronic device or equipment
•Selling or buying of minors
•Sexual misconduct
Then it gets a little more squirrely with out of state registrants coming into Florida. What one state wont consider a "lifetime" registration requirement, often Florida will.

Oh Florida took a lot of the discretion judges had away at least a decade ago on the "nuts and bolts" of sentencing. They were too off the charts and not consistent. There are "some" aspects of compliance registrants can go to a judge with to circumvent the terms and conditions of their status, but not many.

Considering the daily ongoing litigation in any one state all your inquiries can be considered
"trick questions" but every offender/predator is encouraged to go to

Thank you so much for your response, I will look at the pages you recommended. It is pretty confusing at times, but I am extremely appreciative of the registry. We need to know where those who have been convicted of these crimes are, and anyone who would disagree, clearly has their own agenda. Thank you again, your blog is very informative and well written!

I appreciate that, I often look at this blog and think I should put some bells and whistles on it.
If you ever get the chance,(1) encourage people to look at their registry and look at it often, it can change daily.

(2) anyone who comes into contact with your children ask if a background check has been done? Our kids aren't mature or savvy enough to grasp the horrors of what people can and will do to kids, it's up to us as parents to inquire.

(3) Don't take people's word for it, ask to see the paper and make a note of the date of the background check.

(4) Kids at the age of around 9-14 explore their neighborhoods and the Homes of their friends. A neighbor who is the wive, mother, sister etc. of an offender will NEVER volunteer that info to her child's friends parents. (YOU) Abuse Breeds in these circumstances.

(5) Never under-estimate the seriousness of a Child Porn charge. Which is very common these days. CP is often used as an exhilarate prior to offending, during an offense and or to relive the offense.

If you care about India so much, feel free to move there.

By the way, nice attempt at pretending to be someone else. No one would ask you for advice unless they were a dumb drunk just like you.

Let me ask you this anonymous (no balls) is there anything I offered up on this post, that you wouldn't do for your own child if you weren't labeled a deviant?

I thought not..
